Between the Right to Freedom of Speech and Defamation in Evaluating Government Performance on Social Media

Abstract

Freedom of expression is guaranteed by Article 28E paragraph (3) of the 1945 Constitution, yet it often clashes with defamation issues, particularly when criticizing government performance on social media. This study analyzes the boundaries between freedom of expression and defamation in the digital space, as well as the legal protections for both. Using a normative juridical approach and case studies, it finds that the ambiguity of legal norms and the multiple interpretations of articles in the Electronic Information and Transactions Law (UU ITE) have the potential to criminalize public criticism. On the other hand, protecting individuals and institutions from baseless attacks is also necessary. Therefore, proportional law enforcement and adequate public digital literacy are essential so that freedom of expression can coexist with respect for the rights of others.
