Economic renewal is an important factor to improve people's , thus increasing the need for funds, In the distribution of bank credit, collateral has the most important and strategic position. Land is collateral that has the most profitable prospects. What is the way to ensure the resolution of mortgage rights so as not to harm the interests of creditors and still to guarantee legal certainty for creditors. The research method used is the normative legal method in conducting scientific studies of laws and regulations and problems that often arise in society related to mortgage rights or collateral for credit. This legal research focuses on literature studies. That the reason credit service providers like land as. Law Number 4 of 1996 which regulates Mortgage Rights, but when a land that has become collateral and is split, it should be divided first or this must first obtain written approval from the creditor.
