Legal Protection for Creditors in Online Loan Provision on p2p Lending Platforms as a Result of Default

Abstract

This study examines legal protection for creditors in online lending via Peer-to-Peer (P2P) Lending platforms using a normative juridical method. It applies statute and conceptual approaches, analyzing legal materials systematically. Findings reveal that preventive protection is provided through regulations like POJK No. 6/POJK.07/2022, while repressive protection includes credit restructuring. Legal remedies for creditor defaults involve negotiation and the Financial Services Authority’s (OJK) regulatory role. The study concludes that strong legal protection and OJK’s active involvement can enhance trust and ensure legal certainty in the P2P lending ecosystem. It also contributes to legal scholarship and policy development.
