Legal Protection for Holders of Unused Foreign Brands in Terms of the First to File Principle in Indonesia
Perlindungan Hukum Pemegang Merek Asing yang Tidak Digunakan Ditinjau dari Prinsip First to File di Indonesia

A brand is a sign that is displayed graphically in the form of an image, logo in 2-dimensional or 3 dimensional form. Brands are protected for brand owners or users if the brand is registered with the Director General of Intellectual Property Rights, Ministry of Law and Human Rights. The research uses normative methods with a statistical and statutory approach, and obtains data by searching for a number of cases of potentially problematic brands and potentially non-problematic brands on the Supreme Court Decision and DGIP Brand websites. Based on the research results, there are 3 legal protections for foreign brand holders who do not use them from the TRIPS regulations, the Paris Convention and Law no. 20 of 2016, where each regulation has its own limitations. There are 2 (two) forms of legal protection for brands, namely preventive efforts to issue regulations and repressive efforts to provide sanctions for violations.
