This study analyzes the validity of online sales agreements using the COD (Cash on Delivery) payment method
through Facebook, within the framework of Indonesian Civil Code (KUHPerdata) and the Electronic Information and
Transactions Law (UU ITE). Nnormative legal method was applied to examine relevant regulations, particularly
Article 1320 of the Civil Code on the requirements of a valid contract and provisions of UU ITE on electronic
transactions. The findings reveal that electronic agreements are legally binding once digital consensus is reached,
making COD payment merely part of performance fulfillment. Any unilateral price increase after agreement violates
the principles of consensualism, pacta sunt servanda, and good faith, leading to legal consequences such as the
buyer’s right to demand performance, compensation, or contract termination. The study highlights the need for
stronger regulations and legal awareness, as well as effective dispute resolution mechanisms by online platforms to
enhance consumer protection in digital commerce.
