In the era of globalization, the function of technology is increasing, especially technology in the field of information and communication. One of the negative impacts is that it is used as a tool to commit crimes in cyberspace. Illegal trading acitivities in the binomo application are one of the crimes in he cyber world. This legal research focuses on the study of literature. The result of this study is that an illegal binary options actor (affiliate) can be threatened with Article 378 Jo Article 55 of the Criminal Code and Article 28 Paragraph (1) of Law Number 11 of 2008 concerning Information and Electronic Transactions Jo. Article 45A Paragraph (1) of Law Number 19 of 2016 concerning Electronic Information and Transactions (ITE Law), and electronic evidence in trial law is considered valid if it meets the provisions in the ITE Law and is guaranteed authenticity by digital forensic expert witnesses.
