Abstract. This study analyzes Facebook’s legal responsibility as an electronic system provider in cases of Human Trafficking Crimes (TPPO) that occur through its social media platform. Online trafficking cases are increasingly facilitated by the use of social media for recruitment. This research uses a normative juridical method with a statutory and case approach. The results show that Facebook explicitly prohibits human exploitation in its Terms of Service (ToS), but in practice, its content detection and prevention systems are still ineffective. Many trafficking cases pass through both automated systems and manual moderators. Therefore, Facebook can be considered legally, morally, and socially negligent for failing to take maximum preventive measures against human trafficking on its platform.
