Principles of Fairness for Buyers in Clauses of Agreements for Under-the-Table Home Purchase Transactions

Abstract

Contracts serve as the foundation for regulating relationships between parties involved in  business transactions, ensuring the enforcement of rights and obligations, and maintaining  order in the business world. However, the use of standard form contracts also raises questions  about the balance of interests between parties, particularly when one party is  stronger than the  other. The aim of this research is to determine whether the principle of  fairness is encompassed in  Article 5A of agreements for under-the-table property sales  using a juridical normative method with  a statutory approach. The results obtained  indicate that in under-the-table property sale agreements,  there are clauses that do not reflect fairness principles for buyers. It is necessary to amend these  clauses to be more proportional and consider the buyer's capacity while providing alternative solutions.  This is intended to maintain the balance of rights and obligations within the contract and protect  consumers.
