Abstract

For more than two decades, domestic workers in Indonesia have lacked a dedicated legal framework. Existing protection relies on Law Number 13 of 2003 on Manpower, Law Number 23 of 2004 on the Elimination of Domestic Violence, and Minister of Manpower Regulation Number 2 of 2015 concerning the Protection of Domestic Workers. However, these regulations have not provided legal certainty, leaving domestic workers vulnerable to discrimination, limited social security access, and weak enforcement. This study employs a socio-legal method using statutory and interview approaches. The findings show that the Manpower Office regulates the legality of domestic worker placement agencies but lacks authority to supervise employment relationships. The Integrated Service Center for the Empowerment of Women and Children also faces obstacles in assisting victims of violence, while JALA PRT contributes to resolving unpaid wage disputes. Therefore, the Draft Law on the Protection of Domestic Workers is expected to strengthen legal protection.
