Abstract

Capital Punishment in Indonesia remains controversial, especially when a person is wrongfully sentenced
to death because of judicial error. Since the death penalty is irreversible, wrongful executions raise serious
legal and human rights concerns. This study examines the state's responsibility to provide compensation for
wrongful execution cases. It uses a normative juridical method with conceptual, statutory, and comparative
law approaches. The findings show that Indonesia has recognized compensation through Law Number 20 of
2025 on the Criminal Procedure Code, which introduces payment mechanism by state endowment fund after
judicial review. Problem found still lacks detailed provisions on compensation calculation standards,
independent review procedures, specific rules for wrongful execution cases, and a specialized institution to
administer compensation. Comparison with the legal systems of the United Kingdom and Taiwan demonstrates
more comprehensive compensation mechanisms. This study contributes to the development of state
accountability on judicial error for their heir and families.
