Development of the Authority of Professional Disciplinary Council in Resolving Medical Disputes
Perkembangan Kewenangan Majelis Disiplin Profesi dalam Penyelesaian Sengketa Medis

The expansion of healthcare services in Indonesia has increased the complexity of doctor–patient relationships and contributed to more frequent medical disputes involving legal, ethical, and professional issues. Law Number 17 of 2023 on Health introduced the Professional Disciplinary Council (Majelis Disiplin Profesi/MDP), replacing the previous disciplinary framework. This normative legal research uses statutory and conceptual approaches with qualitative analysis to examine the MDP’s authority and patient legal protection. The findings show that the MDP’s authority has expanded to examine disciplinary violations by medical and health professionals and issue recommendations in medical disputes. The law also strengthens patient protection by providing broader access to complaint and dispute resolution mechanisms. However, because MDP recommendations are not legally binding, clearer implementing regulations and stronger institutional coordination are needed to ensure legal certainty and effective protection for both patients and healthcare professionals.
