Marketplace Responsibility for Fake Reviews as a Form of Legal Protection

Abstract

The rapid growth of online marketplaces has made reviews and testimonials essential references for consumers when making purchasing decisions. However, fake reviews remain common in electronic transactions, potentially misleading and harming consumers. This study aims to analyze legal protection for consumers affected by fake reviews and examine the responsibilities of sellers and marketplace providers. The research uses a normative legal method with statutory and conceptual approaches. Primary legal materials include the Consumer Protection Law, the Electronic Information and Transactions Law, regulations on electronic commerce, and the Civil Code. The findings indicate that fake reviews qualify as misleading information, violating consumers’ rights to accurate and honest information. Nevertheless, the implementation of legal protection is still not optimal, particularly regarding the unclear responsibilities of marketplace platforms in monitoring review systems. Therefore, strengthening the role of marketplaces is necessary to enhance effective consumer protection in electronic transactions.
